Terms of Service

1. Acceptance of Terms

By creating an account or using Capturo ("the Platform"), you agree to these Terms of Service. If you do not agree, please do not use the Platform.

2. About Capturo

Capturo is a photography marketplace platform that connects photographers with clients. We provide tools for portfolio management, booking, invoicing, project management, AI-powered smart galleries, and business management.

3. User Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • One person may only create one account
  • You must be at least 18 years old to use the Platform
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Photographer Responsibilities

  • You are responsible for the accuracy of your profile, portfolio, and pricing information
  • You must only upload photos and media that you own or have rights to
  • You must fulfill bookings and deliver services as agreed with clients
  • You are responsible for collecting applicable taxes (GST) on your services
  • You must not upload inappropriate, illegal, or copyrighted content belonging to others

5. Client Responsibilities

  • You must provide accurate event details when making bookings
  • You must pay the agreed amount as per the invoice/quote terms
  • You must not misuse the face recognition feature or download others' photos without permission

6. Smart Gallery & Face Recognition

  • The Smart Gallery feature uses AI face recognition for photo matching
  • By uploading photos, photographers consent to AI processing of facial features
  • Guests who use face search consent to their selfie being processed for matching
  • We do not use facial data for any purpose other than photo matching

7. Payments & Billing

  • Free accounts include a 2-month trial of dashboard features
  • Paid plans (Starter, Pro, Studio) are billed monthly through Razorpay
  • All prices are in Indian Rupees (₹) unless the user selects a different currency
  • Refunds are handled on a case-by-case basis
  • Capturo charges a platform fee; photographer-client payments are separate

8. Intellectual Property

  • Photographers retain full copyright of their uploaded photos
  • By uploading to Capturo, you grant us a license to display your content on the platform
  • Capturo's logo, design, and software are our intellectual property
  • You may not copy, modify, or distribute Capturo's platform code

9. Prohibited Activities

  • Creating fake accounts or profiles
  • Uploading malicious content, viruses, or spam
  • Attempting to hack, scrape, or reverse-engineer the platform
  • Harassing other users
  • Using the platform for illegal activities
  • Misrepresenting your identity or qualifications

10. Limitation of Liability

Capturo is a marketplace platform. We are not party to agreements between photographers and clients. We do not guarantee:

  • Quality of photography services
  • Payment from clients to photographers
  • Availability of photographers
  • Accuracy of profiles or reviews

Our maximum liability is limited to the fees you paid to Capturo in the past 12 months.

11. Account Termination

You may delete your account at any time from Settings. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days.

12. Dispute Resolution

Any disputes shall be resolved under the laws of India, with jurisdiction in Gujarat, India.

13. Changes to Terms

We may update these terms. Continued use after changes constitutes acceptance. Major changes will be communicated via email.
